How much does it cost to hire you?

In British Columbia the standard Contract of Purchase & Sale stipulates that the Seller pay real estate commissions.

The Seller and the Listing Agent decide on how much commission will be offered to Buyer’s agents. Typically half of the total fee is given to the Buyer’s agent. The co-operating commission earned by your Buyer's agent is always disclosed to you when preparing an offer to purchase. For example, a buy-side commission could be in the amount of 3% on the first $100,000 and 1.50% on the balance (may vary).

On completion day, the commission is taken out of the proceeds by the Seller's lawyer or conveyancer.

In most cases 8X gets remunerated by the Seller (not the Buyer). There is no upfront cost to utilize our Buyer Representation Service.

Why should I use a Buyer's agent?

The home buying process is long and can often be complicated to those who are not actively involved in the marketplace.

REALTORS® are trained to provide valuable assistance to buyers in the following areas:

  • Identifying desirable types of properties to acquire
  • Locating properties available to view and consider
  • Preliminary investigation and timely information gatheting
  • Viewing properties and providing guidance and advice
  • Selecting the right property on which to make an offer
  • Preparing a legally binding Contract of Purchase & Sale
  • Negotiating favourable terms and conditions with the Seller
  • Assisting in seeking suitable financing if necessary
  • Assisting in arranging property inspections and other due dilligence services
  • Assisting in the completion and posession process

Why should I not go direct to the listing agent to submit an offer?

The listing agent has primary fiduciary duty to the Seller. Those duties include loyalty, avoiding conflicts of interest, confidentiality, and to act in the best interest of the Seller (gaining highest price / limiting risk).

In 2018 the Superintendent of Real Estate prohibited dual agency (one agent representing both Buyer & Seller). Most listing agents will steer you away to go get your own representation, or ask you to be an unrepresented party.

Opting to be an unrepresented party carries numerous risks. If you choose to be unrepresented you will be treated as 'Non-Client' which means:

  • No Loyalty - they are representing a client with competing interests to yours in the transactions. They must be loyal to the client, not you.
  • No duty of full disclosure - they are not required to give you all the relevant information, which may be material to your purchasing decision.
  • No duty to avoid conflicts of interests - they are not acting in your best interests.
  • No confidentiality - they must share any information you tell them with their clients in a transaction.

If you choose to be unrepresented, know the risks, the listing agent cannot:

  • give you advice on an appropriate price
  • give advice on any terms and conditions to include in the contract
  • negotiate on your behalf
  • share any of their clients confidential information with you: minimum/maximum price, reason for selling
  • protect your confidential information

The Home Buying Process

Submitting an offer does not have to be complicated, but there are a lot of moving parts and dates to keep track of.
‍

01. Submit an offer
12 - 48 hours+

Draft an initial offer for the Seller's consideration.

This will have a set amount of time for the Seller to either accept, reject, or counter offer.

02. Conditional Period
3 - 14 days

Amount of time for the Buyer to complete due diligence items (if any) such as confirmation of financing, home inspection, insurance review.

Some Buyer's may choose to go unconditional to strengthen their offer's appeal.

03. Buyer Rescission Period ('Cooling Off ')
3 business days

A provincially mandated rescission period that runs concurrently with your conditional period (if any).

Should you elect to exercise your rescission right you will pay a small 0.25% fee to the Seller.

04. Subject Removal Date & Deposit
declared in inital offer

Date by which the Buyer declares if they are satisfied or not with their due diligence items.

Buyer either enters into a binding contract of purchase & sale, obtains an extensions, or releases the contract (does not proceed with purchase).

If Buyer waives conditions (proceeds with purchase) then the deposit will become due.

05. Unconditional Period
14 - 60 days+

Amount of time between Subject Removal Date and the Completion Date.

Buyer to prepare transfer of funds to their lawyer or notary in preparation for closing day.

06. Completion Date
declared in initial offer

Date on which the Buyer transfers funds to the Seller, and land title is registered to the new owner.

Often the same day as Posession, when Buyer will get keys and access to the property.
